A trust is a legal agreement that places your assets in the care of another person, usually for the purpose of managing your property and/or money according to your wishes after you’re gone. One of the main objectives of a trust is to minimize the income tax burden for your heirs, as well as the income tax burden on the trust’s assets – but trusts also serve many other purposes in estate planning and wealth management.

Should you decide to establish a trust, one of the first steps is to name a trustee, a person or legal entity responsible for administering your assets. This could be someone you know personally, or it could be a bank or other corporation with trust powers.
You’ll also need to name a beneficiary. This could be your children, spouse or other family members. Or, it could be your favorite charity or any other organization or group that you would like to benefit.
Another important decision you’ll make if you decide to establish a trust is how it will be structured. Here are the basic classifications of trusts:
- Testamentary: The trust is spelled out in the last will and testament of the grantor. Generally, the beneficiary only gains access to the assets following probate of the will.
- Living: A beneficiary might be granted access to the assets before your death. For example, money might be set aside to distribute to a minor child when he or she reaches a certain age.
- Revocable: The grantor has the right to change the terms of the trust after it has become effective.
- Irrevocable: The grantor gives up the right to change the terms after the trust has become effective.
